WHY MEDIATE RATHER THAN LITIGATE?

Divorce can be emotionally taxing, legally complex, and expensive. Mediation reduces these stresses by offering a powerful and effective approach to resolving conflicts amicably.

01

Empowerment and Control

Mediation allows both parties to actively participate in the decision-making process, empowering them to shape the terms of their divorce rather than handing that power over to a judge. It also gives parties the opportunity to voice their concerns for themselves, rather than relying on attorneys to do the talking for them.

03

Confidential

Whereas matters in court become part of the public domain, mediation sessions are private and confidential. This provides a safe environment for open and honest communication and fosters a more cooperative atmosphere.

02

Cost-Effective

The costs of a litigated divorce can add up to tens of thousands of dollars. Mediation requires fewer billable hours and reduces court fees. The solutions themselves also tend to be more cost-effective, since the parties have more flexibility than the rigid constraints often imposed by a judge in litigation.

04

Preservation of Relationships

Mediation is a voluntary process that employs the good faith efforts of both parties to reach an agreement. Through this collaboration, parties can establish a healthier precedent for their relationship going forward. For couples with children in particular, mediation prioritizes the well-being of the whole family and promotes a healthier co-parenting dynamic.

05

Faster Resolution

Parties who litigate their divorce are at the mercy of the court’s calendar, and it can often take years for a divorce to finalize. Parties who mediate, on the other hand, have full control over the timeline of the process and can finalize their divorce in as little as six months from filing the initial paperwork.

07

Flexibility in Scheduling

Mediation sessions can be scheduled at mutually convenient times, providing flexibility for busy individuals and ensuring that both parties have ample opportunity to express their concerns. Video conference calls also allow the parties to meet from the comfort of whatever location they choose, even if miles or states apart.

06

Customized Solutions

Unlike court decisions, which are often one-size-fits-all, mediation allows for personalized solutions tailored to the unique needs and circumstances of each couple. While the law can be a helpful guide to inform your agreements, it doesn't have to have the last word in mediation.

08

Expert Guidance

Mediators guide you through the process, facilitating constructive communication and helping you explore creative solutions that meet your specific needs.

Peace is not merely a distant goal that we seek, but a means by which we arrive at that goal.
